1. Purpose of the platform
Coin des Montres is a marketplace reserved exclusively for private individuals. Any use for professional or commercial purposes, or as part of a trading activity, is strictly prohibited.
2. Definition of a private individual
A private individual is any natural person acting outside any professional or commercial activity, in accordance with the introductory article of the French Consumer Code.
The following are in particular excluded from the platform: traders, professional watch resellers, companies, sole traders engaged in a trading activity, and any person acting in a habitual professional or commercial capacity.
3. Obligations of the private seller
- Active listing limit: each member may have no more than 5 active listings at any one time. This limit preserves the private-individual character of the platform.
- Ownership of items: items offered for sale must belong personally to the seller. Selling on behalf of a third party, or reselling on a habitual basis, is prohibited.
- No habitual reselling: repeatedly listing identical or similar items is considered a commercial activity and results in suspension of the account.
- Certification on sign-up: every new member explicitly certifies that they are acting as a private individual when creating their account.
4. Absolute prohibition on counterfeits and replicas
Coin des Montres applies a zero tolerance policy towards counterfeit watches. The sale, exchange, gifting and any introduction of parties concerning the following are strictly prohibited:
- Counterfeits: any watch reproducing or imitating, without the authorisation of the rights holder, a trade mark, logo, registered design, drawing or any other protected distinctive sign.
- Replicas and fake watches: whatever wording is used to describe them (“replica”, “clone”, “superclone”, “AAA”, an “homage” sold as genuine, and so on).
- Altered watches presented as genuine: non-original parts, dials, movements or components that have been replaced and then presented as original without clear and honest disclosure.
- Falsified documents: counterfeit or falsified certificates, invoices, papers or warranties accompanying a watch.
Legal framework. Counterfeiting is an offence punishable under the French Intellectual Property Code (in particular articles L.335-2 and L.716-9 et seq.). It carries penalties of up to three years' imprisonment and a fine of €300,000, rising to seven years and €750,000 where the offence is committed by an organised group. Manufacturing, importing, holding, offering for sale and selling counterfeits are likewise punishable. The buyer of a counterfeit is also exposed to penalties, including customs penalties.
Sole responsibility of the seller. Every seller warrants the authenticity of the watches they offer and remains solely and fully liable, in both civil and criminal terms, for their conformity and legality. By publishing a listing, the seller certifies that the item is genuine and that they are its lawful owner.
Role and non-liability of the platform. Coin des Montres acts solely as a technical intermediary and does not systematically authenticate the watches listed. The platform cannot under any circumstances be held liable for the sale, circulation or acquisition of a counterfeit between its members. It nevertheless reserves the right, at its sole discretion and without notice, to remove any suspicious listing, to suspend or permanently delete the account concerned, and to retain material relevant to any proceedings.
Reporting and cooperation. Any member may report a questionable listing using the “Report” button on each listing, or by writing to contact@coindesmontres.fr.
Sanctions. Any breach of this clause results in immediate removal of the listing and permanent banning of the member, without notice or refund of any services purchased, and without prejudice to legal proceedings that may be brought by rights holders or the authorities.
5. Sanctions
Any breach of these rules will result in immediate deletion of the account and all associated listings, without notice or refund of any services purchased.
Coin des Montres reserves the right to report any fraudulent professional conduct to the competent authorities, in particular the French consumer protection and fraud authority (DGCCRF).
6. Liability
Coin des Montres acts as a technical intermediary between private sellers and buyers. The platform cannot be held liable for transactions concluded between members, for the authenticity of the watches offered, or for the accuracy of the descriptions published by sellers.
Each member is solely responsible for the content of their listings and for compliance with applicable law, in particular regarding intellectual property and consumer law.
7. Governing law
These terms are governed by French law. In the event of a dispute, the French courts shall have sole jurisdiction. Any dispute shall first be submitted to an attempt at amicable resolution.
